Object and acceptance of the Terms
These Terms regulate access to and use of the Mainder platform (the “Platform”), owned by Mainder. By signing the service contract or using the Platform, the Customer acknowledges and fully accepts these Terms and all clauses detailed below.
User registration and access to the Platform
To access the Platform, Mainder will provide the Customer with access credentials (username and password). These credentials are personal, confidential and non-transferable, and the Customer must ensure their security. Except in case of technical failure attributable to Mainder, the Customer is responsible for any use of their credentials by third parties or activities performed from their account. The Customer must immediately notify Mainder of any suspected unauthorized access or use. The Customer is responsible for safeguarding credentials; Mainder is exempt from liability for unauthorized access resulting from failure to comply with this obligation, including using secure passwords and not sharing credentials. Mainder may request periodic password changes or additional verification for security reasons.
Appropriate use of the Platform — Customer obligations
The Customer agrees to use the Platform solely for professional purposes (recruiting process management) and in accordance with the law and these Terms. In particular, the Customer must: provide truthful and lawful information; process personal data accessed on the Platform in compliance with data protection regulations, with consent where required for candidate data; not use the Platform for illegal, defamatory, offensive, violent, discriminatory or obscene purposes; and not send unsolicited mass communications (spam) or attempt unauthorized access to Platform features, accounts or systems.
Intellectual and industrial property
Mainder owns all intellectual and industrial property rights over the Platform and its components, including software, source code, interface design, database architecture, features, trademarks, logos, trade names, domains, technical documentation and proprietary content. The Customer receives a limited, non-exclusive, non-transferable and revocable license to access and use the Platform during the contract term exclusively for recruiting processes.
Confidentiality
Both parties agree to maintain the confidentiality of all non-public information accessed in connection with use of the Platform, including commercial, operational, personal, trade secret, candidate or client lists, strategies or other non-public content.
Service availability and support
Mainder strives to ensure the Platform is available continuously and securely. However, the Customer acknowledges that uninterrupted or error-free operation cannot be guaranteed. Mainder may perform scheduled maintenance, providing prior notice when possible and scheduling during low-activity periods.
Limitation of warranties and liability
Use of the Platform is at the Customer's own risk. Although Mainder applies high standards of quality, security and accuracy, the Platform is provided “as is” and “as available”, without express or implied warranties regarding performance or suitability for the Customer's specific objectives.
Suspension and termination of the Service
Mainder may temporarily suspend the Customer's access to the Platform or certain features in case of misuse, security breach or violation of these Terms. Whenever possible, notice will be given indicating causes, estimated duration and opportunity to remedy the situation.
Modifications to the Terms of Use
Mainder may modify or update these Terms to adapt to legislative changes, service improvements or new features. Any modification will be communicated electronically (Platform notification, registered email or prominent notice on the website).
Final provisions
Complete agreement: These Terms, together with specific commercial conditions agreed with the Customer and Mainder's Privacy Policy, constitute the complete agreement regarding use of the Platform. Applicable law: The relationship between Mainder and the Customer is governed by Spanish law, except mandatory consumer protection rules. Jurisdiction: Any dispute arising from interpretation, execution of these Terms or use of the Platform is expressly submitted to the Courts of Barcelona, Spain, waiving any other jurisdiction.
